Real estate laws vary by state and local government, but federal real estate laws may take precedence over local real estate laws.

Contract law is the area of law that governs how agreements between parties are created, interpreted, and enforced. It's a fundamental part of commercial dealings, ensuring that parties can rely on the commitments they make to each other.
A contract is an agreement between two parties that creates an obligation to perform or not perform a particular duty. A legally enforceable contract also requires mutual consideration, which is the value received and given, and legal parties and purpose.
The goal of contract law is to ensure that all terms and conditions of a contract are followed. Most contract laws are bound by the state in which the contract was created, and contracts should include a governing law provision that outlines the state's specific laws. Contracts should also specify how disputes will be handled and the consequences for breach of contract.
If a promise is breached, the law provides remedies to the harmed party, often in the form of monetary damages. In limited circumstances, the harmed party may also be able to receive specific performance of the promise made.

Contract law
The principle that a non-breaching party in a contract must take reasonable steps to minimize their losses after the other party breaches the contract.
The contractor had a duty to mitigate the damages by stopping construction.
If a claimant fails to mitigate their losses, they cannot recover damages for the portion of their loss that is due to their own actions.
Criminal defense
A complex approach to preparing for sentencing that aims to reduce the effects of aggravating factors.
Mitigation is the part of the defense that tells the story of the defendant as a person, before, during, and after the crime.
For example, if a defendant is facing criminal charges and an acquittal isn't realistic, mitigation can help convince the court to be lenient with the sentence.

For example, in California, the implied warranty of habitability requires builders to construct homes in a safe and habitable condition, and to inform buyers of any major defects before they purchase.

For example, construction lawyers may represent property owners, developers, and contractors in filing and responding to lien disputes.

Construction law also deals with infrastructure, housing, planning permissions, engineering, and related fields.
For example, federal, state, and local laws can dictate road placement, how far back a house can sit from the street, and how many fasteners are required to hold up a sheet of drywall.
Construction law has two main categories: non-contentious and contentious. Non-contentious work involves negotiating contracts and general procurement before construction begins. Contentious work involves issues that arise when something goes wrong during construction.
